Legislative Report – Sept. 19, 2024

My comments:

There is very little to update at this time.

Remember that the NYS Legislature (both the Assembly and the Senate) is in recess until January 2025 unless called back into session by the Governor due to an emergency. As this is an election year for all Assembly and Senate positions in NYS, any bill that has not passed both houses is dead and must begin the process again in January 2025. Only those bills that passed both houses can be sent to the Governor’s desk for her signature or veto. Those bills are reviewed in the June and July reports.

On a Federal level, remember that Congress takes its annual hiatus during August. Since returning to session after Labor Day, their big issue is to fund the Government.

So, little to see here.

Legislative Report – July 24, 2024

My comments:

New York State’s Legislature is in recess until a new session starts in January (excepting emergencies as declared by the Governor). Bills that did not pass both the Assembly and the Senate these past two years must start from square one (meaning January and February of 2025 will be busy). Hopefully the lazy firearms owners in NYS will wake up and vote on the State Assemblypersons and State Senators as all positions are up for election. Change can happen if people vote for change…pro 2A candidates frequently support common sense conservation and environmental issues. Do not expect much on state issues the rest of this year.

On a Federal level despite the events of the past several weeks, Congress will recess for August before the election season heats up. I have listed the resolutions/bills that have been introduced since my last column. Individual comments are in green. On a Federal level we are all aware of the importance of this Presidential Election. While you may not be enthralled with Republican Candidate Donald J. Trump, do you realistically believe that you can endure the continued and perhaps more forceful policies of the Democratic Party leadership in the areas of Immigration, Welfare, Inflation, Energy Reform, Additional Court Reform, Education Reform, and Firearm Control. Ready to give up your personal safety?

I am sure everyone is now aware that you will receive a radically different hunting license this year. Educate yourself on the changes.

Remember that despite the decisions released the SCOTUS at the end of June, nothing has changed in New York State. Everything must go through the process through the 2nd Circuit Court allowing NYS to delay the beginning of the restoration of our rights. There are more lawsuits being filed, many of which are merely the same suits with different names. Beware of the newcomers soliciting your hard-earned dollars to ultimately pad their pockets. It has happened in other states.

Supreme Court Hearing results:

 

Gazzola v. Hochul, Petition for Writ of Certiorari was denied. This implies it is sent back to the discovery stage in the 2nd Circuit. Nothing changes in CCIA.

        Antonyuk v. James is held over for another week.

        Chevron case: still awaiting ruling.

 

2nd Circuit Court:

There are no changes in any rulings for the 2nd Circuit Court on any of the lawsuits or requests for relief on any of the cases.

May 19, 2024 Supreme Court of the United States (SCOTUS) update:

In a decision released today in Bianchi v. Brown 23-863, regarding the assault weapons ban and definitions in a case currently before the 4th Circuit Court on appeal, SCOTUS decided not to hear the case. It is felt that because the 4th Circuit has not ruled on the constitutionality of the case, SCOTUS will not hear it.

SCOTUS has not yet ruled on hearing a similar case from the state of Illinois in the 7th Circuit.

Antonyuk v James is scheduled to be heard in conference on June 6 or 13 or 20 with a decision due the following Monday.

A decision in the Chevron U.S.A, Inc. v. Natural Resources Defense Council, Inc. 467 U.S. 837 (1984) is expected this term. A favorable ruling would greatly diminish the ability of Federal Government Agencies (e.g. ATF, IRS, et. al.) and the President to issue “rulings” or executive orders and have them enforced as law, thereby circumventing the Congressional legislative process. Bump stock and suppressor rulings would be gone as an example.

 In Congress, there is a bill being proposed to repeal the Federal Tax on firearms and accessories that are regulated under the 1934 National Firearms act.

The DHS is monitoring the purchase of 3-D printers sold through Amazon, E-Bay, and others.
