Bills Introduced or Re-introduced since January 24, 2024
On a Federal level I am sure many of you have heard or read about S.3589. This bill is now in committee in the Senate. If it comes out of committee and passes in the Senate, it then must pass through the House before it can be given the President for his signature or veto. Among other things, it would restrict firearms training taken out of state, eliminate any magazine holding more than 10 rounds, restrict the type of training and limit the size of groups with semi-automatic weapons to 2 or less in training scenarios. These restrictions do not apply to Law Enforcement or Military Personnel.
The other notable Federal Bill is S3407 introduced by Senator Elizabeth Warren. It would create a Federal 10-year renewable license to own and purchase firearms and ammunition. It includes a Federal Tax on firearms (30%) and ammunition (50%) to fund an anti-gun violence program, a federally enforced safe storage regulation, formalized assault weapon definitions, federalized Red Flag laws, and more. This bill is in committee.
The major NYS lawsuit decisions in favor of restoring 2A rights are still stayed by the 2nd Circuit Court, pending a request for an en-banc hearing by the State. A petition has been submitted to SCOTUS to break the logjam. The 4th Circuit has been in a similar logjam and this week the 4th Circuit administration has ruled that the 4th Circuit 3-person judge cases, cannot use this type of delay (at least one case has been held up awaiting a ruling for a year).
Gun Owners of America (GOA) is filing a lawsuit against NYS for not issuing concealed carry permits to out of state citizens who have legal permits in their home states. At this point NYS is the only state who will not.
Regarding important Federal cases before the Supremes, the case of Chevron v. Natural Resources Defense Council is very important. This case was originally found in favor of Federal Agencies defining their own rules as law if it is reasonable (e.g. ATF defining bump stocks as machine gun applications) and skirting the Congressional lawmaking process. If the SCOTUS overturns Chevron, then many ATF regulations will be overturned and the number of Executive orders issued will be reduced.
